2. Emergency Services
For Life-Threatening Emergencies: Always Dial 911
Our ambulance services are designed to provide emergency and non-emergency medical transport. In cases of immediate life-threatening emergencies, you should always dial 911 first. Our services complement, but do not replace, emergency 911 response systems.
- Emergency response times may vary based on location, traffic, weather conditions, and ambulance availability.
- We make every effort to respond promptly to emergency calls, but cannot guarantee specific response times.
- Emergency medical decisions are made at the discretion of our certified EMTs and paramedics based on patient condition and medical protocols.
3. Service Availability
Our ambulance services are available 24/7/365 subject to the following conditions:
- Service availability depends on ambulance fleet capacity and staffing levels at the time of request.
- We reserve the right to refuse or discontinue service if patient behavior poses a safety risk to our staff or other patients.
- Weather conditions, natural disasters, or other unforeseen circumstances may affect service availability.
- Non-emergency transport services may be scheduled in advance and are subject to availability.
4. Patient Responsibilities
By using our services, patients and/or their authorized representatives agree to:
- Provide accurate and complete medical information, including current medications, allergies, and medical history.
- Cooperate with EMTs and paramedics during assessment, treatment, and transport.
- Follow medical advice and instructions provided by our emergency medical personnel.
- Inform us of any changes to contact information, insurance coverage, or medical conditions.
- Ensure payment for services rendered in accordance with our billing policies.
- Treat our staff with respect and refrain from abusive, threatening, or violent behavior.
5. Medical Treatment and Consent
By requesting our ambulance services, you consent to emergency medical assessment and treatment as deemed necessary by our certified medical personnel. This includes but is not limited to:
- Vital signs monitoring and physical examination
- Administration of oxygen and medications
- IV placement and fluid administration
- Advanced airway management if required
- Cardiac monitoring and defibrillation if necessary
- Wound care and bleeding control
- Immobilization and splinting
Patients or their authorized representatives have the right to refuse treatment. However, refusal of treatment releases Audubon Ambulatory Surgery Center LLC from liability for any consequences resulting from such refusal.
6. Billing and Payment
Payment Terms:
- All ambulance services are subject to fees based on the type of service, level of care, mileage, and supplies used.
- We accept most major insurance plans. Patients are responsible for verifying coverage with their insurance provider.
- Patients are responsible for co-pays, deductibles, and any services not covered by insurance.
- For uninsured patients, payment arrangements should be discussed prior to non-emergency transport services.
- Bills are typically sent within 30 days of service. Payment is due upon receipt unless other arrangements have been made.
- Late payments may be subject to interest charges and collection efforts in accordance with applicable law.
7. Insurance and Medicare/Medicaid
- We bill Medicare, Medicaid, and most private insurance companies directly as a courtesy to our patients.
- Insurance coverage for ambulance services typically requires medical necessity as determined by established criteria.
- Patients are ultimately responsible for all charges, regardless of insurance coverage determinations.
- We will provide all necessary documentation to support insurance claims.
8. Cancellation Policy
Non-Emergency Transport Cancellations:
- Scheduled non-emergency transports may be cancelled without penalty if notice is provided at least 2 hours prior to scheduled pickup time.
- Cancellations with less than 2 hours notice may be subject to a cancellation fee.
- No-shows (when ambulance arrives and patient is not available) will be charged a service fee.
- Emergency calls cannot be cancelled once dispatched without potential charges for response costs incurred.
9. Limitation of Liability
To the fullest extent permitted by law:
- Audubon Ambulatory Surgery Center LLC shall not be liable for any delays in response or transport caused by traffic, weather, mechanical failures, or other circumstances beyond our reasonable control.
- Our liability for any claims arising from our services shall be limited to the amount paid for the specific service giving rise to the claim.
- We are not liable for outcomes related to patient medical conditions, only for the care provided by our personnel within the scope of their training and certification.
- We maintain appropriate liability insurance as required by state and federal regulations.
Important: This limitation does not apply to cases of gross negligence or willful misconduct by our personnel.
10. Confidentiality and HIPAA Compliance
We are committed to protecting patient privacy in accordance with the Health Insurance Portability and Accountability Act (HIPAA):
- All patient medical information is kept strictly confidential.
- Information is only shared with receiving medical facilities, insurance companies, and other entities as necessary for treatment, payment, and healthcare operations.
- Patients have the right to request copies of their medical records in accordance with HIPAA regulations.

11. SMS Text Messaging Terms
Opt-In and Consent:

13. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.
- Any disputes arising from these terms or our services shall be resolved through binding arbitration in Colorado Springs, Colorado, except where prohibited by law.
- Each party shall bear their own costs and attorney's fees unless otherwise awarded by the arbitrator.
- In emergency situations involving patient safety, either party may seek injunctive relief in court.
14. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any modifications constitutes acceptance of the updated terms.
